The letter of the Surveyor General shows that lot 87 is registered in the Land Office in the name of Fletcher & Co.; it's annual rental amounting to £18. 6s. has been paid up to 27th June last, and the new lease asked for in the name of the Executor to the Estate, will be for 272 square feet at an annual rental of £19.
I brought the matter before the Executive Council on the 30th Instant, and it was resolved to submit the proposal to the favorable consideration of your Lordship.
Refers to an application from Messrs Turner & Co. for the resumption of Inland lots 14 and 63, upon which a bungalow has been built, the property of Mr. McCulloch of their firm. It appears that Turner & Co. made a previous application last year, of a similar purport, which was referred to the then Acting Attorney General, vide Colonial Secretary's letter with Mr Campbell's opinion thereto affixed - but as no further steps were taken by them.
Sir John Davis considered the whole subject in Council on the 3rd Instant, and as a previous application was made last year, the Colonial Secretary was instructed to address Turner & Co. with regard to their paying the rent up to the end of last year, to which they having assented, and paid the same into the Treasury, their petition is also recommended to the favorable consideration of Your Lordship.
The third and last is as follows: Messrs. Macvicar & Co. applied for the Government to resume lot No. 40, belonging to their firm, taken out in the name of Mr. Burn of Scotland; no lease was ever granted for this lot; the ground has been much improved, and no benefit derived by Mr. Burn; the rent was paid up to the 24th June, 1847; and the matter being submitted to Council, it was deemed proper to recommend the resumption of the lot to the consideration of Your Lordship.
The opinion of the Attorney General on each of these cases is attached to the enclosures.
